Will the NextGen UBE test family law and trusts and estates?

From July 2026 through February 2028, family law concepts will appear on every NextGen exam in a performance task and may also be included in integrated question sets. During this period, family law concepts will be tested with the provision of legal resources. Starting in July 2028, family law will be included in the Foundational Concepts and Principles tested on the NextGen UBE and will be tested in the same manner as the other foundational concepts. This means that some family law topics will be tested without provision of legal resources, and that family law will be tested in the standalone multiple-choice questions and may be tested in integrated question sets and performance tasks. The family law outline, which lists the family law content that will be tested beginning in July 2028, is available on the NCBE website at https://www.ncbex.org/exams/nextgen/content-scope.  

Trusts and estates will also appear on every NextGen UBE from July 2026 through February 2028 in a performance task and may appear in integrated question sets; after July 2028, it may be tested in one or both of these question types. Because trusts and estates is not part of the Foundational Concepts and Principles, it will only be tested with the provision of legal resources (e.g., statutes, regulations, and case law); the key information examinees need to know about trusts and estates will be included in the resources.
