NCBE MPRE Candidate Rules Agreement

The following is a review of policies you agreed to as part of the NCBE MPRE registration process and an explanation of Pearson VUE testing center procedures you must follow. Contact the Pearson VUE Test Administrator (TA) if you have any questions. The term TA will be used in this document to mean test administrator, invigilator, and proctor. You are required to follow TA instructions at all times.

1. Reminder of prohibited conduct: The MPRE is owned by NCBE and is a secure examination protected by U.S. copyright laws. Conduct undermining the integrity and fairness of the examination process is prohibited before, during, and after the examination. If you are dismissed from the testing center for any reason, you will not be eligible for a refund or transfer of any testing fees. 

2. Personal items: Except for your primary ID and permitted comfort aids, no personal items are allowed in the testing room, including but not limited to cell phones, hand-held computers/personal digital assistants (PDAs) or other electronic devices, e-cigarettes, watches, larger jewelry, wallets, purses, firearms or other weapons, hats (and other nonreligious head coverings), bags, coats, jackets, eyeglass cases, books, notes, scratch paper or paper of any kind, pens, or pencils. All electronic devices must be turned off before being stored in a locker. You may not access your stored personal items during your testing appointment; if you plan to use any permitted comfort aids during your testing session, you must bring them with you the first time you enter the testing room. The testing center is not responsible for lost, stolen, or misplaced personal items. If you refuse to store your personal items, you may be prohibited from testing. Bringing unauthorized personal items into the testing room may result in your immediate dismissal and/or the cancellation of your score, among other penalties. You will be asked to empty your pockets to allow the TA to verify that nothing is in them. You may be asked to show your ears, for example, to allow the TA to verify that no wireless devices are present. The TA may also ask you to roll up your sleeves, for example, to verify that you have no writings on your arms. Before you enter the testing room, you will be asked to remove larger jewelry and hair accessories and to pat yourself down (for example: arms, legs, waistline) to show there is nothing hidden on your body. Studying is not allowed in the Pearson VUE testing center. Visitors, children, spouses, family, or friends are not allowed in the Pearson VUE testing center. 

3. Identification: Before you enter the testing room, you must present acceptable primary and secondary forms of identification. Then the TA will collect your digital photograph and digital signature for the purposes of verifying your identity and protecting the security and integrity of the test. If there are any discrepancies during the check-in process, you may be prohibited from testing. If you are allowed to test, your score may be cancelled, among other penalties. The identification requirements used during the check-in process are defined by NCBE, and the TA has no flexibility to alter this process. 

4. Entering the testing room: The TA will provide you with an erasable noteboard and a marker and escort you to your workstation. You may not remove these items from the testing room at any time during the exam, and you must return all items to the TA after the exam. You may not write on the erasable noteboard until after the exam has started. If you need a new noteboard or marker during the exam, raise your hand and the TA will assist you. 

5. Inside the testing room: The TA will log you in to your assigned workstation. You will verify that you are taking the MPRE. You will have up to five (5) minutes to review the MPRE instructions and certification. The MPRE will begin automatically after five (5) minutes or will begin when you click Next. Unless otherwise instructed, you must remain in your assigned seat until escorted out of the testing room by a TA. You may not communicate with other candidates, including during any unscheduled breaks. You understand that eating, drinking, chewing gum, smoking, and/or making noise or moving disruptively is prohibited during the test. Any disruptive, threatening, or fraudulent behavior (including accessing personal items) in the testing room will be reported to NCBE and may result in immediate dismissal from the testing center and/or cancellation of your score, among other penalties.

6. During the test: If you experience any problems or distractions or if you have other questions or concerns, you must raise your hand, and the TA will assist you. You may not tamper with the computer or any other Pearson VUE equipment. The TA cannot answer questions related to test content. If you have concerns about a test question, make a note of the question number on your erasable noteboard and report it to the TA after you have completed the test. If you think that any testing irregularity occurred that may impact your score, you must contact NCBE in writing within three calendar days of your testing appointment; it is not enough to notify the TA. 

7. Unscheduled breaks: There are no scheduled breaks during the two-hour MPRE. It is in your best interest to use the restroom or otherwise address personal needs before beginning the MPRE. If you need to take an unscheduled break (for example, to stand and stretch or to use the restroom), you must raise your hand and wait for the TA to assist you. Your test time will NOT stop. You must take your ID with you when you leave the testing room. You may not leave the testing center building or access your stored personal items. If you need to use the restroom, you must use the restroom that is closest to the testing room. The TA will check your ID when you leave and re-enter the testing room. Before re-entering, you will be asked to pat yourself down again (arms, legs, waistline). The TA will escort you to your assigned seat and log you in to your assigned workstation so that you can continue with the test. Note that long and frequent unscheduled breaks will be subject to further investigation and reported to NCBE. 

8. Monitoring: To ensure a high level of security, the testing center and testing room will be monitored at all times. Both audio and video of you may be recorded during testing. 

9. When you are finished testing: After you have completed the test you must raise your hand, and the TA will come to your workstation and verify that your test session has ended properly. You must present your ID again to the TA and return your erasable noteboard and marker. You must not leave any materials at your testing workstation after you have completed the MPRE. You will be provided with a testing completion notice indicating that you have completed the MPRE.

 

By providing a digital signature, I certify that: 

• I am the person who registered with NCBE to take the MPRE and whose name appears on the primary and secondary IDs that I presented to the TA. 

• As part of the registration process, I read the Candidate Agreement and the MPRE registration and test day policies, and I agree to comply with and be bound by the policies and procedures set forth therein and as given in this NCBE Candidate Rules Agreement. 

• I will neither assist nor receive assistance from any other candidate during timed testing. 

• I will not disclose, transmit, copy, or otherwise reproduce any MPRE test questions or answers, in whole or in part, during or after the test, whether orally, in writing, electronically, or otherwise. 

• I acknowledge that the MPRE is part of the bar examination requirements of participating jurisdictions, and the same standards of conduct by the candidates apply as if the test were being administered by a bar authority. I further acknowledge that any misconduct in connection with the MPRE may be reported by NCBE to the appropriate bar authority. In addition, my request for authorization to take the MPRE may be denied, my registration may be cancelled, I may be dismissed from the testing center, and/or my score may be cancelled, among other penalties.

 

Your Privacy: Your test results will be encrypted and transmitted to Pearson VUE and the test sponsor. The test center does not retain any information other than when and where your test was taken. The Pearson VUE Privacy and Cookies Policy provides additional information, which you can obtain by visiting the Pearson VUE website at www.pearsonvue.com or by contacting the Pearson VUE call center.

Candidate Statement: By providing a digital signature, I give Pearson VUE my explicit consent to retain and transmit my personal data and test responses to Pearson VUE located in the U.S. and to the test sponsor (either of which may be outside of the country in which I am testing). I understand the information provided above and agree to follow these rules in addition to any other program rules I may have agreed to during my registration for this test. If I do not follow the rules or I am suspected of cheating or tampering with the computer, this will be reported to Pearson VUE and the test sponsor, and I acknowledge and understand that my test may be invalidated, and the sponsor may take other action such as decertifying me, and I will not be refunded my test fee.
